Confidentiality, Privacy, and Law Enforcement

The Linwood Public Library is committed to protecting the privacy of those who use the library and its services, including their personal information. The policy applies to all circulation and library use records including the internet use as well as any identifiable information.

  1. The Library only collects personal information which is used to fill their needs and conduct daily operations of the library and its connection to the patron.
  2. Library records are confidential.
  3. The USA PATRIOT Act of 2008 has been established for government use to conduct investigations, video or listen to an individual in the event there is deep concern about the purpose and actions of a patron.
  4. Records of patron use of library materials or services are confidential per NJSA 18A;73-43.1. Library records which contain identifying details are confidential and shall not be disclosed except in accordance with NJSA 18A: 73-43.2.
  5. If a law enforcement agent or officer requires records and presents a subpoena from the courts, we must seek legal counsel for review. Based on the advice of a legal counsel, the director or appointed individual whether to release the requested information or seek further counsel or court information.
  6. Government surveillance may occur if illegal or inappropriate behavior is a concern.

We will protect to the best of our ability the rights of a patron as established by the ALA. This policy reflects the Code of Ethics of the American Library Association which states, “We protect each library user’s right to privacy and confidentiality with respect to information sought or received and resources consulted, borrowed, acquired, or transmitted.”
